These Terms and Conditions establish the conditions for sales made between any individual who wishes to make a purchase of Waatic products and The Waatic Company, S.L., a company of Spanish nationality, registered with the number B-10911170, in Barcelona, with its registered office at Can Noguera, 19 Nave 1-2 08630 - Abrera (Barcelona) Spain (Together "Waatic", "us" or "we" as required by the context)
These Terms and Conditions apply only to purchases made by an official distributor or manufacturer. Occasionally we may change these Terms and Conditions. We will detail in the header the effective date. Any change in the Terms and Conditions will apply to orders placed on or after the effective date.
BY PLACING AN ORDER FOR PRODUCTS, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ACCEPT THEM.
Please note that orders can only be placed by legal entities, such as companies. Therefore, we will not accept orders placed by individuals.

In case you have created an account with a personal user identification and a password, keep your password protected at all times and do not disclose it to anyone, as you are personally responsible for each purchase made with your user identification and password.
You agree that your order is an offer to buy the Products listed in your order, in accordance with these Terms and Conditions. All orders must be accepted by us.
We may decide, at our sole discretion, not to accept orders, abnormal orders, orders that we suspect have not been made in good faith or orders that have not been made by legal entities.
After receiving your order, if we accept it, we will send you an order confirmation by email, with your order number and with the details of the Product(s) you have requested and the Terms and Conditions. The contract will be entered into at the moment you receive the order confirmation by email.
You are responsible for the accuracy of the information you provide to us.
The order confirmation email constitutes your proof of purchase. Please keep it.
The price charged for a Product will be the price in effect at the time the order is placed and will be reflected in the order confirmation email.
We may change prices at any time without prior notice. Price increases will only apply to orders placed after such changes.
The price of the Product(s) includes VAT, but does not include shipping and handling charges, customs, or other types of taxes. Unless otherwise specified on the e-commerce product page.
Charges for shipping, handling and their corresponding VAT or other taxes, will be shown in the confirmation email of your Order.
In case certain charges cannot be reasonably calculated before the contract is concluded, we will inform you of the way in which the total price will be calculated.
We deliver the Product(s) worldwide and in accordance with the following restrictions:
The delivery options are as follows:
Standard: Estimated delivery time of 10 working days in the European Union, international shipments may take longer.
Both the delivery time and the delivery option you choose will be confirmed in the order confirmation.
The delivery period will not exceed 30 days from the conclusion of the contract, unless you specifically accept a later date. In case you do not receive the order within this period, you will have the right to require us to deliver, giving us a new reasonable delivery period. If this does not happen, you may terminate the contract and have the right to be reimbursed all amounts you have paid.
We may reject those orders where you require a certain delivery period, if this implies the impossibility of complying with the required delivery period. In those cases where you have required delivery within a certain period or days, you will have the right to terminate the contract if we do not comply with the specific period.
If you place an order for customized Product(s), the manufacturing time for such Product(s) will be added to the delivery time of the selected supply option.
In case you unreasonably evade delivery or delay receipt of delivery after we have notified you that we have tried to deliver the requested Product(s), or in case you have provided us with an incorrect delivery address that results in a failed delivery, the package to be delivered will be returned to us. If, after the first delivery attempt, the Product(s) remain undelivered for a period of 7 working days and are returned to us undelivered, we will have the right to cancel the contract and refund the amount in accordance with the provisions of Article 9.
We will not be responsible for delay or non-compliance if the delay or non-compliance is due to circumstances beyond us in accordance with the law or generally accepted principle.
We ask you to examine the delivered package and the received Products within 14 (fourteen) days from the time they were delivered to you and check their condition and that the content of the delivered package is complete. In case of damage to the Product(s) or in case any Product is missing, please contact us through the emails, phones and forms intended for this purpose.
Unless we accept your order, we reserve the right, without liability or prior notice, to change, suspend or interrupt the availability of any Product.
When placing an order, please make sure that the Product(s) you purchase is/are compatible for the intended use. Please use the information provided as a final reference point for you when checking compatibility.
Payments will be made by bank transfer.
All payments will be subject to security checks.
Therefore, it is possible that our services will contact you to confirm your order information, as well as order details, such as delivery address, delivery schedule, etc.
Please note that we will only process returns and refunds for Product(s) purchased at The Waatic Company, S.L.
Right of Withdrawal: If you have purchased Product/s and wish to exercise your right to withdraw from the contract and return the Product(s), you may do so by sending an email to info@waatic.com or calling 0034 93 770 50 97, within 14 days from the date you received the Product(s). In the case of a contract relating to multiple Products, your right of withdrawal will expire within 14 days from the date you received the last product.
To exercise your right of withdrawal and return the Product(s), please send an email to info@waatic.com or call 0034 93 770 50 97 indicating the reason for withdrawal, the invoice number, the day received, company and the email with which you made the purchase and the address where it was delivered.
You may only return the Product(s) that have been reasonably cared for by you and have not been used and are sealed in their original packaging. You will be responsible for any decrease in the value of the Product(s) resulting from a use by you of the Product(s) other than that use necessary to determine the nature, characteristics and correct operation of the Product(s) you have purchased.
PLEASE NOTE THAT YOU WILL NOT BE ABLE TO EXERCISE THIS RIGHT OF WITHDRAWAL WITH RESPECT TO: - ANY PRODUCT THAT HAS BEEN MANUFACTURED IN ACCORDANCE WITH THE CONSUMER'S SPECIFICATIONS OR HAS BEEN CLEARLY CUSTOMIZED
Once we have received your online statement regarding the withdrawal from the contract, we will send you a confirmation email.
You must then return the Product(s) without undue delay and, in any case, no later than 14 days from the date you notified your decision to withdraw from the contract. You will bear the costs of returning the Product(s).
Return Procedure.
You must return the Product(s) in their original package.
You must include all accessories, user manuals and any free gift that was in the same package.
In case a Product has been purchased as part of a set of multiple Products, all Products that are part of the set must be returned.
Please treat the Product(s) with reasonable care and return it/them in the same condition in which it/they were delivered to you.
Please package the Product(s) in a secure way and make sure that the RMA number (which will have been previously provided to you by phone or email) is clearly visible on the outside of the package. Process to receive the RMA number.
Right of Withdrawal: In order to ensure a quick and safe return, we suggest you comply with the following return instructions:
We will refund the price you have paid for the Product(s) plus the initial shipping costs within 2 days from the date we have received the returned Product(s) in our warehouse.
In case you have chosen the express delivery option, only the initial shipping costs corresponding to the standard delivery option will be refunded.
The refund will be confirmed by email.
The payment will be made through the same means of payment that you used in the initial transaction.
If you return Product/s 1) that you are not authorized to return, 2) that you have damaged or used differently than that necessary to determine the nature, characteristics and operation of the Product(s) or 3) that are not complete 4) that you have not treated with reasonable care during the time you have had them in your possession and/or when returning them, we reserve the right, either to reject your return and decline the refund or to deduct from those payments that must be refunded to you the decrease in value of the Product, all in accordance with applicable law.
Other cases of return: In case the Product(s) you have received do not correspond to the one(s) you have requested, or in case your order is incomplete or has been damaged during transport, please contact us, either via email or by phone, to receive assistance.
We grant you a legal warranty in accordance with the laws of Spain.

We will take reasonable care to keep secure the information related to your order and payment, however (in case there is no serious negligence on our part) we will not be responsible for any damage and/or harm that you may suffer in case third parties perform unauthorized access to any of the data you have provided.
These Terms and Conditions set forth all of our obligations and responsibilities in relation to the Product(s). To the maximum extent permitted by applicable law, we do not grant any warranties, whether express or implied, nor do we accept other conditions or other terms that bind us, except those expressly mentioned in these Terms and Conditions. In particular, we will not be responsible for ensuring that the Product(s) are suitable for your purposes, unless you have informed us of such purposes at the time of the conclusion of the contract and we have accepted them.
We will make reasonable efforts to verify the accuracy of any information we include on the web and application. We do not guarantee that the web and application meet your requirements or do not suffer interruptions or do not contain errors, nor that the defects will be corrected, nor that the site or the server that allows its availability are free of viruses or errors or that allow the full functionality, accuracy and reliability of the Online Store. We will not be responsible to you for any loss of content or material downloaded or transmitted through the Online Store.
We will not, under any circumstances, be responsible for loss of income, loss of profit, loss of contracts, loss of business or anticipated savings, loss of data, loss of goodwill or loss of reputation or for any damages and/or losses, whatever their nature or the way in which they originate.
